1. Acceptance of terms

By accessing or using ExaStore (“the platform”, “the service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. ExaStore is operated by ExaStore (“we”, “our”, “us”). Contact: grow@exagrowth.com.

2. The service

ExaStore provides an AI-powered platform for businesses to create and manage online stores, accept payments, manage bookings, and view analytics. Features may change over time. We will communicate significant changes in advance.

3. Accounts and eligibility

You must be at least 18 years old to create an account.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity that occurs under your account.
One person or legal entity may not maintain more than one free account.

4. Acceptable use

You agree not to use ExaStore to:

Sell illegal products or services.
Engage in fraud, deception, or misleading practices toward customers.
Violate any applicable laws or regulations.
Transmit malware, spam, or harmful code.
Attempt to gain unauthorised access to any part of the platform or other users' accounts.
Reverse engineer or copy any part of the platform.

We reserve the right to suspend or terminate accounts that violate these rules.

5. Payments and fees

Subscription fees (where applicable) are billed in advance on a monthly or annual basis.
A platform transaction fee applies to each sale, as specified in your plan.
All fees are non-refundable except where required by law.
You are responsible for all taxes applicable to your sales.
Payment processing is handled by Stripe or PayPal — their terms also apply to transactions.

6. Free trial

New accounts on the Starter plan receive 3 months of free access. All other paid plans include a 30-day free trial. No credit card is required to start. After the free period, standard pricing applies and you will be notified before any charges begin. We reserve the right to modify or end promotional offers at any time for new sign-ups.

7. Your content

You own the content you upload to ExaStore (product images, descriptions, store branding). By uploading content, you grant us a limited licence to display and deliver it to your customers through the platform. You are responsible for ensuring your content does not infringe third-party rights.

8. Intellectual property

The ExaStore platform, logo, design, and technology are owned by us and protected by intellectual property laws. You may not use our branding without written permission.

9. Limitation of liability

To the maximum extent permitted by law, ExaStore is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of revenue, data, or business opportunities. Our total liability to you in any month shall not exceed the fees you paid to us in that month.

10. Disclaimer of warranties

The platform is provided “as is” without warranty of any kind. We do not guarantee uninterrupted, error-free service. We will make reasonable efforts to maintain uptime but cannot guarantee 100% availability.

11. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these terms. Upon termination, your store will be taken offline and your data will be retained for 30 days before deletion, unless legally required otherwise.

12. Changes to terms

We may revise these terms at any time. We will give you at least 14 days' notice of material changes via email. Continued use of the platform after changes take effect constitutes acceptance.

13. Governing law

These terms are governed by applicable law. Any disputes will be resolved through binding arbitration or in the courts of competent jurisdiction.
